Rouille & Apéro — version dated 3 October 2026
Article 1 — Publisher
These terms and conditions of sale ("T&Cs") are issued by:
Simon Wills (Sole Trader), trading as Rouille & Apéro, 94 Rue Maurice Denis, App 12B, 29150 Châteaulin, France.
SIRET: 992 419 986 000 11.
Email: contact@rouille-apero.fr.
VAT not applicable under Article 293 B of the French Tax Code.
Article 2 — Scope and Acceptance
These T&Cs apply to all orders placed on the Rouille & Apéro website by consumer customers. By confirming their order, the customer acknowledges having read and accepted these T&Cs without reservation (checkbox required before payment).
Article 3 — Products
Our products are made to order by our partner Printful (print-on-demand). Colours may vary slightly depending on screens and production batches. Visuals shown are non-contractual within these variations.
Article 4 — Prices
Prices are in euros. VAT not applicable under Article 293 B of the French Tax Code. Delivery costs are calculated and displayed before final order confirmation. Rouille & Apéro reserves the right to change prices at any time, without effect on orders already confirmed.
Article 5 — Order and Payment
The order is confirmed upon payment confirmation. Payment is made online by credit card or Shop Pay via Shopify Payments. A confirmation email is sent to the customer as soon as possible.
Rouille & Apéro reserves the right to refuse or cancel an order in the event of an existing dispute with the customer, payment failure, or suspected fraud.
Article 6 — Delivery
Products are delivered to the address provided by the customer at the time of ordering, to the following countries: metropolitan France and the European Union.
As products are made to order, estimated lead times are 5 to 12 business days depending on destination, including production. These times are indicative.
In the event of a delivery delay, the customer may require Rouille & Apéro to deliver within a reasonable additional period. Failing delivery within that period, the customer may cancel the contract (Articles L216-2 and L216-3 of the French Consumer Code). In any event, delivery must occur within 30 days of the conclusion of the contract, unless otherwise agreed.
Risk of loss or damage transfers to the customer upon physical receipt of the parcel (Article L216-4 of the French Consumer Code). In the event of a damaged or missing parcel, the customer is invited to record reservations with the carrier and contact us without delay.
Article 7 — Right of Withdrawal
7.1 Principle. In accordance with Articles L221-18 et seq. of the French Consumer Code, consumer customers have 14 days from receipt of the product to exercise their right of withdrawal, without giving reasons or paying penalties.
7.2 Exception. This right does not apply to products made to the customer's specifications or clearly personalised (Article L221-28, 3° of the French Consumer Code), for example a product bearing text or a visual supplied by the customer. Products from our standard catalogue are not affected by this exception.
7.3 Process. To exercise this right, the customer notifies their withdrawal decision by an unambiguous statement (by email to contact@rouille-apero.fr or by post to the address in Article 1). The model withdrawal form in the annex may be used, though it is not mandatory.
7.4 Return. Upon receipt of the withdrawal notification, we will communicate the return address to the customer by email within 2 business days. The customer must return the product within 14 days of notifying their decision, and only to the address we have provided. Direct return costs are at the customer's expense. The product must be returned in a condition suitable for resale. The customer's liability is limited to the depreciation of the product resulting from handling beyond what is necessary to establish its nature, characteristics, and proper functioning.
7.5 Refund. Rouille & Apéro refunds the customer the full amount paid, including standard delivery costs, within 14 days of being informed of the withdrawal decision. The refund is made upon receipt of the product or, if earlier, upon receipt of proof of shipment provided by the customer. In the event of depreciation resulting from handling beyond what is necessary to establish the product's nature, characteristics, and functioning (wear, washing, soiling, damage), Rouille & Apéro may deduct from the refund an amount corresponding to that depreciation. The refund is made by the same payment method as the original order.
Article 8 — Legal Guarantees and Defects
Independently of the right of withdrawal, all products benefit from the following legal guarantees:
- Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): for 2 years from delivery, the customer may request repair or replacement of the non-conforming product, or failing that, a price reduction or cancellation of the contract. The customer is not required to prove that the defect existed at the time of delivery during this period.
- Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the customer may choose between cancellation of the sale or a price reduction. The action must be brought within 2 years of the discovery of the defect.
In the event of a defective, non-conforming, or incorrectly fulfilled product, the customer contacts Rouille & Apéro at contact@rouille-apero.fr, attaching photos of the product and its label where possible. We undertake to offer, as appropriate, a replacement or refund. We ask customers to report the issue within 14 days of receipt to facilitate processing, without this period limiting their legal rights.
Article 9 — Intellectual Property
The trademark "Rouille & Apéro" is in the process of being filed with the INPI. All designs, visuals, texts, and logos on this site are the exclusive property of Simon Wills. Any reproduction or representation, in whole or in part, is prohibited without prior written authorisation.
Article 10 — Personal Data
Personal data collected during the order is processed for order management purposes (payment, production, delivery, customer relations) and shared with our service providers (in particular Printful for production and shipping) only to the extent necessary. To find out more about how your data is processed and to exercise your rights (access, rectification, erasure, etc.), please consult our privacy policy: here.
Article 11 — Consumer Mediation
In the event of a dispute, the customer should contact Rouille & Apéro first (contact@rouille-apero.fr) to seek an amicable solution. Failing a satisfactory response, the customer may use the following free consumer mediation service:
Société Médiation Professionnelle — Alteritae, 5 rue Salvaing, 12000 Rodez — www.mediateur-consommation-smp.fr
Article 12 — Governing Law and Disputes
These T&Cs are governed by French law. In the event of a dispute, and failing amicable resolution, the competent courts shall be determined according to applicable rules of common law, the consumer customer being able in particular to seize the court of their place of residence at the time of conclusion of the contract or the occurrence of the harmful event.
